Companies need to understand what the real risks are in contracting. By and large, we see a huge lack of understanding of the true risks in this area. Procurement organizations seek to “drive good performance” with the contracts, but many don’t even take the time to define what that means! And given that their budgets (and the budgets of legal departments) are stretched, it’s understandable. Companies need to be more efficient AND effective in identifying and mitigating commercial risk.
